Terms of Service
These terms are an agreement between you and Blackhorse Capital LLC, which operates Kinduty ("Kinduty," "we," "us"). By creating an account or using Kinduty, you agree to these terms and to our Privacy Policy.
Kinduty is not medical advice or an emergency service. It helps families organize care. It doesn't diagnose, treat, or monitor anyone, and reminders can be delayed or fail to arrive. Always follow the advice of doctors, pharmacists, and other professionals. In an emergency, call 911.
1. Your account
- You must be at least 18 to use Kinduty.
- Give us accurate information and keep your password secure. You're responsible for activity on your account.
- Tell us right away at support@kin-duty.com if you think your account has been accessed without permission.
2. Care teams
- A care team is a private group. Everyone in it can see and change its tasks, appointments, and other content.
- The person who creates a care team is its coordinator. The coordinator manages its plan and can invite people or archive it.
- Only invite people you want to share this information with. If you add information about someone else, such as the person you care for, you're responsible for having the right to share it with your care team.
3. Your content
You own what you and your family put into Kinduty. You give us permission to store, process, and display it only as needed to run Kinduty for your care team, as described in our Privacy Policy. You can download a copy at any time.
4. Acceptable use
Don't use Kinduty to break the law; harass, threaten, or harm anyone; share content you don't have the right to share; send spam; try to access accounts or care teams that aren't yours; interfere with or overload the service; or copy, resell, or reverse-engineer it.
5. Free trial and family plans
- Each new care team gets a free 7-day trial. No payment details are needed to start.
- To keep using a care team after the trial, its coordinator chooses a family plan: $5.99 per month or $59.99 per year (US dollars, plus any applicable taxes). One plan covers every member of that care team.
- Plans renew automatically at the end of each billing period at the then-current price until canceled. We'll tell you before any price change takes effect.
- The coordinator can cancel any time from Family settings → Manage billing. Cancellation takes effect at the end of the current billing period, and the care team keeps access until then.
- Payments are processed by Stripe. Except where required by law, payments are non-refundable and we don't provide refunds or credits for partial periods.
- If a payment fails or a plan ends, the care team's content is kept and stays downloadable, but members can't make changes until a plan is active again.
6. Text messages and notifications
Text reminders are optional and off until you verify your phone and turn them on. Message frequency varies. Message and data rates may apply. Reply STOP to stop, START to resume, or HELP for help. Carriers aren't responsible for delayed or undelivered messages. Email, text, and push reminders are a convenience; don't rely on them alone for anything time-critical.
7. Changes to Kinduty
We're always improving Kinduty and may add, change, or remove features. If we discontinue Kinduty, we'll give you reasonable notice and a way to download your content.
8. Ending your use
You can stop using Kinduty and delete your account at any time. We may suspend or close accounts that violate these terms or put others at risk, and will tell you why when we reasonably can.
9. Disclaimers
Kinduty is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise that Kinduty will be uninterrupted or error-free, or that any reminder will be delivered on time.
10. Limitation of liability
To the fullest extent the law allows, Kinduty won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to Kinduty is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not apply to you.
11. Indemnity
If you use Kinduty in violation of these terms or the law, you agree to cover reasonable losses and legal costs we incur because of it.
12. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Los Angeles County, California, unless the law where you live requires otherwise.
13. Changes to these terms
If we make material changes, we'll update the date above and notify you by email or in Kinduty before they take effect. Continuing to use Kinduty afterward means you accept the updated terms.
